The Land Title Registration Division of the Lands Commission in Kumasi will soon start issuing land title certificates to land owners who apply to its office to register their title land.
According to section 43 sub-section 1 of the PNDCL 152, the rights of a person who register his or her land is be indefeasible and shall be held free from all encumbrances. On registration, the land certificate issued in respect of land is to be signed and sealed by the Land Registrar and marked with the serial number of the folio of the register.
However, since the creation of the Kumasi Land Title Registry by the Land Title Registration Law, 1986 (PNDCL 152), now a division of the Lands Commission established by the Lands Commission Act, 2008 (Act 767), all land title certificates in Kumasi had had to be signed and sealed in Accra, the national capital.
This arrangement often caused unnecessary delays in the processing and issuance of title land certificates in Kumasi. But according to a new directive issued by the National Lands Commission, the Ashanti Regional Lands Commission will now be issuing land title certificates for areas declared as land title registration zones in Kumasi. Such areas include all, Bantama, Dichemso, New Tafo, Buokrom, Asafo, Ridge Residential Area, Danyame, Amakom and several other areas.
According to sources, the directive took effective from 1st July, 2010 but things are yet to be put in place to facilitate the smooth implementation of the directive.
